Terms and conditions

These Terms and Conditions (the “Terms”) form a binding agreement between you and the operator of ParaguayInmo, the AMC360 real-estate intelligence service (“ParaguayInmo”, “we”, “us” or “our”), covering paraguayinmo.com and its related features (the “Service”). By accessing or using the Service, creating an account, submitting content or continuing after notice of updated Terms, you confirm that you have read and accepted them. If you do not agree, do not use the Service.

You must be at least 18 years old and legally capable of entering this agreement. If you act for a company, agency or another person, you represent that you have authority to bind them. Nothing in these Terms excludes rights that cannot lawfully be waived, including mandatory consumer rights.

ParaguayInmo is a search, aggregation and analytical information service for the Paraguayan property market. We display listings, maps, official administrative zones, price-per-square-metre indicators, comparables, estimated returns, market reports and the ParaguayInmo/AMC360 index.

Unless a page expressly states otherwise, we are not the owner, seller, landlord, buyer, tenant, broker, agent, appraiser, lender, insurer, escrow provider or legal representative in a property transaction. We do not make offers, hold deposits, verify title, guarantee payment or conclude property transactions for users. Any transaction is solely between the relevant third parties on terms they agree independently.

Listings and related material may come from public third-party portals, brokers, agencies, owners, users or other lawful sources. Source names, marks and images remain the property of their respective owners. Identification of a source is for provenance and comparison only and does not imply sponsorship, endorsement, partnership or affiliation.

Third-party content may be changed or removed at its source without notice. We may normalize, translate, deduplicate, geocode, categorize, summarize or correct formatting, but that does not make us the author or guarantor of the underlying listing. The original source controls its own content and availability.

Property data can be incomplete, duplicated, stale, mistranslated, incorrectly categorized or inaccurate, including price, currency, surface area, ownership, availability, condition, permitted use, expenses, taxes and location. A status such as “active”, “verified” or “recently checked” describes only our latest recorded signal; it is not a warranty that the property remains available or that every fact is correct.

Map positions reflect the stated location precision. Street, neighborhood and city locations are estimates, not exact property coordinates. Never use a map position as a boundary survey, cadastral record, title reference, navigation instruction or safety representation.

The ParaguayInmo/AMC360 index, comparables, price per m², market position, valuation ranges, financing simulations, yields, returns and reports are automated statistical estimates based largely on advertised—not necessarily transacted—prices and on assumptions that may not fit a particular property. Small samples, broad locations, currency conversion, data quality and market changes can materially affect results.

Nothing in the Service is an appraisal, offer, guarantee, recommendation, credit decision, or financial, investment, legal, cadastral, engineering, architectural, environmental, insurance or tax advice. No result promises future value, rental income, financing, liquidity or transaction success.

Before visiting, paying, signing or making any decision, independently verify the identity and authority of the counterparty; current price and availability; title, liens, cadastral records and boundaries; zoning and permitted use; building condition and measurements; utilities, occupancy, taxes, expenses, permits and applicable law. Use qualified local legal, notarial, engineering, tax, financial and real-estate professionals. Do not transfer funds merely because a listing or report appears on ParaguayInmo, and report suspected fraud promptly.

You are responsible for accurate account information, all activity under your account and maintaining control of your email account, magic links, devices and sessions. Notify us promptly of suspected unauthorized access. We may require verification, restrict features, refuse registration, merge duplicate identities, suspend or close accounts where reasonably necessary for security, legal compliance, abuse prevention or enforcement of these Terms.

If you submit a listing, photo, agency profile, report, message, review, CRM record or other material (“User Content”), you retain any rights you hold but are solely responsible for it. You represent that the content is accurate to the best of your knowledge, lawful, not misleading, kept current, and that you have all rights, permissions and lawful bases needed to provide and publish it—including for personal data, images, addresses, third-party client records and intellectual property.

Do not upload confidential, sensitive or unnecessary personal data; discriminatory or unlawful material; malware; content that infringes rights; or information obtained without authorization. Agents and agencies must obtain any required notice or consent before entering client data and must use those records only for legitimate professional purposes. Moderation does not transfer your responsibility to us.

You grant us a non-exclusive, worldwide, royalty-free, sublicensable and transferable license, for as long as reasonably necessary to operate, secure, promote and improve the Service, to host, store, reproduce, cache, resize, translate, format, analyze, index, display and distribute User Content. The license ends when the content is deleted from active systems, except for cached or backup copies, lawful records, content shared with others, and material we must retain to exercise or defend rights. You waive no moral right where waiver is prohibited by law.

You may not: break any law or third-party right; impersonate anyone; misrepresent a property or your authority; scrape, crawl, copy or extract the Service at scale except with our written permission or as allowed by law; evade access controls or rate limits; reverse engineer non-public systems; introduce malware; probe security without authorization; overload or disrupt the Service; harvest personal data; spam; manipulate rankings or analytics; create fraudulent accounts, listings or reports; use automated output to make unlawful discriminatory decisions; or help anyone do the same. Ordinary search-engine indexing that respects our published controls is permitted.

We may—but are not required to—review, label, refuse, correct, de-rank, pause, remove or preserve content and accounts when we reasonably believe they are inaccurate, duplicated, unlawful, unsafe, abandoned, infringing or inconsistent with these Terms. To report an error, unavailable property, privacy concern or infringement, use the reporting tools or contact contact@amc360.com.py with the URL, the issue, your authority and supporting details. We may forward a notice to the relevant source or user where appropriate.

The Service may link to or depend on portals, map and tile providers, identity, hosting, storage, analytics, currency, financing and other third-party services. Their content, availability, security, accessibility and practices are outside our control and governed by their own terms. A link is not an endorsement. You assume the risks of visiting or dealing with a third party, subject to rights the law does not allow us to exclude.

The Service, software, design, compilation, taxonomy, original text, reports, graphics and ParaguayInmo/AMC360 branding are owned by us or our licensors and protected by applicable law. These Terms give you only a limited, revocable, non-exclusive, non-transferable right to use the Service for its intended purpose. They do not grant rights to source material owned by listing portals or other third parties. You may share links and use ordinary personal extracts with attribution, but may not reproduce a substantial part of the database or imply our endorsement without permission.

We may add, modify, limit, suspend or discontinue features, sources or the Service, and may impose reasonable usage limits. We do not promise uninterrupted, error-free, secure or permanently available operation, preservation of any feature or content, or compatibility with every device. We will use reasonable care but are not liable for events outside our reasonable control, including provider, network, source-site, power, cyberattack, labor, governmental or force-majeure events, to the extent the law permits.

To the fullest extent permitted by applicable law, the Service and all content are provided “as is” and “as available”, without express or implied warranties of accuracy, completeness, title, non-infringement, merchantability, fitness for a particular purpose, availability, security or results. We do not warrant any user, source, counterparty, property, transaction or professional. This disclaimer does not exclude an express commitment we make to you or a warranty that cannot lawfully be excluded.

To the fullest extent permitted by law, ParaguayInmo and its owners, personnel, affiliates and suppliers will not be liable for indirect, incidental, special, exemplary, punitive or consequential loss; loss of profit, revenue, opportunity, goodwill or data; financing or transaction failure; property defects; fraud by a third party; or decisions based on listings, maps, estimates or reports, even if advised that loss was possible.

Where liability may lawfully be limited, our aggregate liability arising from the Service will not exceed the greater of the amount you paid us for the affected Service during the preceding 12 months or USD 100. This section does not limit liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, breach of a non-waivable duty, or any remedy or consumer right that applicable law prohibits us from limiting. Your sole remedy for dissatisfaction with the free Service is ordinarily to stop using it.

To the extent permitted by law, and except where you act as a consumer within a non-waivable protection, you will defend, indemnify and hold harmless ParaguayInmo and its owners, personnel, affiliates and suppliers from third-party claims, losses and reasonable costs arising from your User Content, your transaction or professional activity, your unlawful or unauthorized use of the Service, your breach of these Terms, or your infringement of another person’s rights. We will give reasonable notice and may control the defense; you may not settle a claim imposing liability or admissions on us without written consent.

You may stop using the Service and may request account deletion subject to the Privacy Policy. We may suspend or terminate access immediately where reasonably necessary to address security, fraud, illegality, harm, repeated infringement, non-payment, material breach or provider requirements, and otherwise with reasonable notice where practicable. Provisions that by nature should survive—including ownership, licenses already relied on, disclaimers, liability, indemnity, dispute and record-retention terms—survive termination.

We may update these Terms for legal, security, operational or feature changes. We will post the new date and, for material changes affecting registered users, provide reasonable notice through the Service or available contact details. Changes apply prospectively from the stated effective date. If the law requires renewed consent, we will request it. Continuing to use the Service after the effective date means acceptance; otherwise, stop using it and close your account.

These Terms are governed by the laws of the Republic of Paraguay, without regard to conflict-of-law rules. Before filing a claim, contact us and allow 30 days for a good-faith attempt to resolve it. Subject to any mandatory consumer forum, residence-based right or exclusive jurisdiction that cannot be changed by contract, disputes will be submitted to the competent courts of Asunción, Paraguay. We may seek urgent injunctive relief in any competent court to protect security, confidential information or intellectual-property rights.

If any provision is unlawful or unenforceable, it will be enforced to the maximum lawful extent and the remainder will continue. Our failure to enforce a provision is not a waiver. You may not assign these Terms without consent; we may assign them with the Service or business, subject to applicable law. These Terms and the Privacy Policy are the entire agreement about the Service unless a separate written agreement applies. Questions and formal notices may be sent to contact@amc360.com.py.
